TERMS OF SALES
1 Scope
The present general conditions of sale apply between the Sole Proprietorship named Laines & Co (also called "seller" in this document) on the one hand and on the other hand the non-professional natural persons wishing to acquire the items offered on the Laines & Co site, referred to as “customer” in this document.
The company Laines & Co, registered with the RCS of Mulhouse under the number 519 297 337 and whose head office is located at 21 rue de Dietwiller, 68440 Eschentzwiller owns the online sales site www.lainesandco.com .
The general conditions of sale are made available to the customer on the site www.lainesandco.com at any time. These apply without restriction or reservation and Laines & Co reserves the right to modify the general conditions of sale in the event that the case law in force in France should change. However, the general conditions of sale posted online apply at the time of the order.
The validation of the order by the customer implies acceptance of the general conditions of sale in which the contractual relations between Laines & Co and the customer are defined for the placing of the order, the payment, the confirmation of the order and the delivery.
2 The command
The customer can choose the items he wishes to order directly on each "product" page and add the desired quantity to his basket. The order is then accessible via the basket at the top of each page.
In this basket, the customer has the possibility of:
- change the quantity of an item
- delete an item or add one
- to delete the order
- validate his order by selecting the method of payment
The order will only be final after payment of the corresponding price. The validation of the order implies acceptance of the general conditions of sale.
The customer has the possibility to choose his method of shipment: withdrawal from one of the locations of the tour of the wool truck or sending by LaPoste. He is then required to provide a valid delivery address.
When validating the order, the customer acknowledges having read the fixed amount of the delivery costs.
The customer obtains for each order a confirmation by email from Laines & Co.
Laines & Co undertakes to notify the customer immediately by e-mail if a product is no longer available for sale. The customer may then request within 7 days, the substitution of the product by another at the equivalent price or request reimbursement of the amount of the price of the missing product.
3 Prices and shipping costs
The prices appearing on the site are in Euros TTC (all taxes included) and the price HT (excluding taxes) as well as the amount of taxes of 20 percent are indicated on the customer invoice, issued by Laines & Co upon delivery of the products. orders.
The current price is the one indicated on the site. This price does not include delivery costs which are invoiced in addition.
The delivery package includes packaging, preparation and transport. It varies according to the amount of the order and the country of delivery. The list of shipping costs is available on the site.
4 Methods of payment
The customer has the possibility to pay for his order by the following means of payment: credit card (paypal or online banking site), check or transfer.
Credit card payments are debited when the order is shipped.
The sales contract will be final as soon as we have received the validation of the payment by our bank.
For payments by Paypal, the customer will use the secure Paypal site to enter the information necessary for payment. Customers who already have a PayPal account can pay directly with their PayPal account.
Orders paid by check will be dispatched within 48 hours from the cashing of the check.
Laines & Co reserves the right to cancel the delivery of an order if the payment conditions are not respected.
5 Delivery
The delivery of the articles is done as soon as possible, within a maximum period of 30 days, the stamp of LaPoste being taken as proof.
In case of impossibility of delivery due to an invalid address, the costs of reshipping the order are the responsibility of the customer.
The products will be sent by LaPoste in Colissimo France for France and in Colissimo followed with signature for the other destinations. The delivery address is the one indicated at the time of the order.
Any delivery problems, damage or loss of parcels are the responsibility of LaPoste and cannot be attributed to Laines & Co.
In the event of a problem of deterioration or loss, an investigation will be requested from LaPoste. Compensation will be made according to the CGV of the package transport service provider.
The customer is required to check his order, condition and content, upon receipt and to report within 5 days any non-compliance or apparent defect of the products received. After this period, the delivery is considered to be in conformity and no complaint can be accepted by Laines & Co.
If, on the other hand, an error or a defect has been noted and verified, Laines & Co will replace the items as soon as possible.
6 Right of withdrawal
The customer has a period of 15 working days from receipt of his order to use his right of withdrawal. The items must then be returned in their original packaging, in perfect condition and at the customer's expense. This right does not apply to items that are stained, damaged, started, damaged and items that have been in a smoking environment. Also excluded are magazines and skeins put into balls at the customer's request.
The exchange or refund of intact items will be made within 30 days of receipt of the items returned by the customer. Laines & Co will reimburse by the same method of payment as the one chosen by the customer for his order.
7 Liability
Laines & Co undertakes to present the products sold on the site www.lainesandco.com with the greatest possible precision. It remains to be specified, however, that Laines & Co cannot be held responsible for technical failures of the Internet network and the uneven quality of transmission which are likely to alter the quality of the images, photos, colors and texts of the site www.lainesandco.com . The illustrations and photos on this site have no contractual value and cannot therefore engage the responsibility of the seller.
Laines & Co makes every effort to secure the pages and information on its site, in particular financial data.
Laines & Co cannot be held responsible for the risks associated with the use and browsing of the internet.
Laines & Co cannot be held liable or in default for non-performance or delays which may be due to the occurrence of a case of force majeure recognized by French case law.
8 Warranties
In accordance with the legal provisions, the products sold on the Laines & Co site benefit from the legal guarantee of conformity, the legal guarantee against hidden defects due to a material or manufacturing defect rendering the delivered products unsuitable for use and of the manufacturer's warranty depending on the brands concerned. All the products offered on the site also comply with the French regulations in force.
Laines & Co cannot guarantee quality control of all the products offered on its site without risking damaging or altering the products or their packaging.
The seller undertakes to replace the products under warranty deemed to be defective.
Some products sold by Laines & Co are handcrafted (in particular the dyes) and no guarantee as to the colors (no reference or batch number), the weight of the balls and the dimensions can be given by the seller.
9 Intellectual property

It is protected by French legislation relating to intellectual property. All elements that are part of the site including content, images, sounds, designs are the property of Laines & Co and its partners. Any partial or total use, reproduction, copy, publication, display or distribution of the site www.lainesandco.com without the explicit and written authorization of Laines & Co is prohibited and considered as an infringement of the provisions of the legislation relating to intellectual property. .
10 Applicable law and jurisdiction
The present general conditions of sale apply on the whole of the French territory as well as for all the European Union insofar as the respect of the legislations in force in each of the member countries.
They are subject to French legislation and in particular to law Nr 2004-575.
Only the French version shall prevail in the event of a dispute.
Any dispute in connection with this contract will fall, in the absence of an amicable agreement, under the jurisdiction of the Court of the place of residence of the defendant and subject to the application of French law.
11 Data processing and Freedoms
The data recorded on the www.lainesandco.com site has been declared to the Cnil under number 2057834v0, in accordance with the Data Protection Act.
This information requested when placing an order on the site is in no way sold or rented to other organizations or companies.
